The big problem I have is you’re criminalizing the war, that if we caught bin Laden tomorrow, we have mixed theories and couldn’t turn him over to the CIA, the FBI, military intelligence for an interrogation on the battlefield, because now you’re saying he’s subject to criminal court in the United States and you’re confusing the people fighting this war.”
And later:  “This is a perversion.”

    excellent! I could not agree more with Mr. Graham on this point. We are fighting a war right now just as sure & serious and dangerous as the one we fought against Japan and Germany in the 40′s. The enemy is very similiar to those foes in it’s rigid ideology (fascism Vs. Islamo-fascisim) and just as determined (if not more) to suceed in imposing it’s will on the rest of the world. The world has moved away from the set piece battles of WWII. Today’s war is referred to as “asymmetric warfare”. A clear example of the beginnings of this was Viet Nam. Small groups of black pajama clad fighters took on the best military ever fielded. The Viet Kong “won” that war despite the fact that our men & women in the field never lost a battle. The “Americans at home” became unwilling to endure the pain. Today the enemy has taken that unconventional warfare to the next (the ultimate) level by making those same “Americans at home” actual targets. They will go to ANY length to win-the more terrible the better. Thus the name “terrorists”. The goal is anything that will cause the max of pain (physical,emotional,psychological,etc.,etc.)divide us,decrease our resolve. Treating them like common criminals (miranda rights, civilian trials etc.) plays into their hands. How? It creates divisiveness, and allows them to turn one of our greatest strengths (the civillian justice system) into a weakness. Here they would have the right to remain silent etc, etc. They would have the PRESUMPTION of innocence vs. the need to prove innocence in a mil. tribunal. civil trial also allows them access to valuable evidence (inteligence) along with a pulpit from which to spew their poison. During WWII several German spies/saboteurs were landed via submarine, on the East Coast. They were intent on causing destruction of wartime industry. All eight men were quickly caught. They were tried in a military tribunal (despite objections up to the Supreme Court) as spies. six were promptly executed, two (who assisted the govt.)were scentenced to prison. This is how we should treat ANY “operative” who is caught. Why? Because they are engaged in warfare against the U.S. They do NOT follow laws of war. In fact I would argue that their aim would be to break these very laws which are created to limit the suffering and terror caused by warfare. Their aim is to maximize suffering and terror. In order to defeat them the US (the world) must treat them with the same ruthless determination to prevail. The question is whether or not the people have that determination. I fear that we may need to be subjected to more pain. I pray that the CinC is man enough for the job, and that he loves his country enough (in its imperfect current state, far inferior to his utopic vision {?The USSSA?})to do what is needed for our safety and survival as a republic.
